These Terms & Conditions govern your use of aenoq.com and any purchase you make from Aenoq. By placing an order, you agree to these terms. Please read them carefully.

Aenoq is an online eyewear brand based in Rotterdam, the Netherlands. We sell non-prescription fashion eyewear to consumers within the European Union.

1. Definitions

  • Aenoq / we / us — the seller, operating from Rotterdam, the Netherlands.
  • You / customer — any natural person placing an order for personal, non-commercial use.
  • Products — the non-prescription fashion eyewear offered on aenoq.com.
  • Order — a confirmed purchase made through aenoq.com.

2. Applicability

These terms apply to every offer, order, and agreement between you and Aenoq made through aenoq.com. We may update these terms from time to time. The version in effect at the time of your order applies to that order.

3. Products

Aenoq sells non-prescription fashion eyewear, including sunglasses. Our products are sourced and curated by Aenoq. They are not intended as medical devices or corrective eyewear.

We present our products as accurately as possible. Slight variations in colour or finish may occur due to screen settings or the nature of the materials. Such variations do not constitute a defect.

4. Prices and Payment

All prices on aenoq.com are in euros and include VAT. Shipping is free for all EU orders.

The price displayed at the time you place your order is the price you pay. We reserve the right to change prices at any time, but changes do not affect orders already confirmed.

We accept the following payment methods:

  • Mastercard
  • iDEAL
  • Apple Pay
  • Bancontact

Payment is processed at the time of purchase through our secure payment provider. Your order is confirmed only after successful payment.

5. Orders and Contract Formation

Placing an order constitutes an offer to purchase. The contract between you and Aenoq is formed when we send you an order confirmation by email. We reserve the right to decline any order for legitimate reasons, such as product unavailability or suspected fraud. If we decline your order, any payment already made will be refunded in full.

6. Shipping and Delivery

We ship to addresses within the European Union. Shipping is free on all orders.

Estimated delivery time is 3 to 5 working days from the date of order confirmation. Delivery times are estimates, not guarantees. Delays may occur due to circumstances beyond our control.

Risk of loss or damage passes to you upon delivery. If a package is lost or arrives damaged, contact us at hello@aenoq.com and we will resolve it.

If we are unable to deliver within 30 days of your order, you have the right to cancel your order and receive a full refund.

7. Right of Withdrawal

Under the EU Consumer Rights Directive, you have the right to withdraw from your purchase within 14 days of receiving your product, without giving any reason. Aenoq extends this period to 30 days.

How to exercise your right of withdrawal

  1. Email us at hello@aenoq.com within 30 days of receiving your order. State clearly that you wish to return your purchase. Include your order number.
  2. We will confirm your return request and provide return instructions.
  3. Ship the product back to us within 14 days of notifying us of your withdrawal.
  4. The product must be returned in its original condition and packaging, unworn and undamaged. You may inspect the product as you would in a physical store, but use beyond what is necessary to assess the nature and characteristics of the product may reduce your refund.

Return costs

The cost of return shipping is your responsibility unless the product is defective or we shipped the wrong item.

Refund

Once we receive the returned product and confirm it meets the return conditions, we will issue a full refund to your original payment method within 14 days. We may withhold the refund until we have received the returned product or you have provided proof of shipment, whichever comes first.

8. Legal Guarantee of Conformity

Under EU law, you are entitled to a minimum two-year legal guarantee on all products. This means that the product must conform to the contract of sale for at least two years from the date of delivery.

If a product is defective or does not match its description, you have the right to:

  • Have the product repaired or replaced free of charge.
  • Receive a price reduction or full refund if repair or replacement is not possible or not carried out within a reasonable time.

To make a claim under the legal guarantee, contact us at hello@aenoq.com with your order number and a description of the issue. We may ask for photographs of the defect.

This legal guarantee exists in addition to, and does not limit, your right of withdrawal.

9. Limitation of Liability

Aenoq is liable only as required by Dutch law and EU consumer protection regulations. Nothing in these terms limits or excludes our liability for:

  • Death or personal injury caused by our negligence.
  • Fraud or fraudulent misrepresentation.
  • Any liability that cannot be excluded or limited under applicable law.

To the extent permitted by law, our total liability for any claim arising from or related to a purchase shall not exceed the price you paid for the product in question.

We are not liable for indirect, incidental, or consequential damages, including but not limited to loss of profit, data, or goodwill.

Aenoq products are fashion eyewear. They are not certified as personal protective equipment. Do not rely on them for eye protection in hazardous conditions.

10. Intellectual Property

All content on aenoq.com — including but not limited to text, images, logos, product designs, and brand elements — is the intellectual property of Aenoq or its licensors. You may not copy, reproduce, distribute, or use any content from this website without our prior written consent.

11. Privacy and Data Protection

We process your personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Dutch privacy law. For full details on how we collect, use, and protect your data, please read our Privacy Policy.

By placing an order, you acknowledge that we process your personal data as described in our Privacy Policy for the purposes of fulfilling your order, communicating with you, and meeting our legal obligations.

12. Use of the Website

You agree to use aenoq.com only for lawful purposes. You must not:

  • Use the site in a way that violates any applicable law or regulation.
  • Attempt to gain unauthorised access to any part of the site or its systems.
  • Interfere with or disrupt the operation of the site.
  • Use automated tools to scrape or extract content or data.

13. Force Majeure

Aenoq is not liable for delays or failure to perform our obligations if caused by circumstances beyond our reasonable control. This includes, but is not limited to, natural disasters, pandemics, war, government actions, supply chain disruptions, and carrier delays. We will notify you of any significant delay and work to resolve it as quickly as possible.

14. Complaints and Disputes

If you have a complaint, contact us at hello@aenoq.com. We aim to respond within 5 working days and to resolve complaints within 14 working days.

If we cannot resolve your complaint to your satisfaction, you may use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

15. Severability

If any provision of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be limited or removed to the minimum extent necessary. All remaining provisions will continue in full force and effect.

16. Governing Law and Jurisdiction

These terms are governed by the laws of the Netherlands. Any dispute arising from these terms or your use of aenoq.com will be submitted to the competent court in Rotterdam, the Netherlands.

If you are a consumer residing in the EU, you also benefit from any mandatory provisions of the consumer protection law of your country of residence. Nothing in these terms affects your rights as a consumer under applicable local law.
